We observe and document that many school districts have space to accommodate new students and have long term declining enrollments. Yet, growth mitigation fees are collected when there is no growth in student enrollments. We believe this is a violation of state law – Gov Code 66001 and Ed Code 17620.  Even though we document NO growth from CBED’s and graphs from the State Department of Education consultants performing the growth impact fee justification studies project growth to impact the classroom space.   We are preparing to advance litigation in districts that have long term declining enrollments and empty classrooms.
